What Do I Need to Know After a DUI or APC Arrest in Oklahoma?
First and foremost you need to know that your Oklahoma DUI or APC will result in two processes: one criminal and one civil.
If you’ve been arrested for DUI (Driving Under the Influence) or APC (Actual Physical Control) in Oklahoma, there are two separate actions that the state will pursue against you. The first is the criminal case, where the prosecution may seek fines, jail time, probation, or other penalties.
The second is a completely separate action involving your driver’s license. This process, managed by the State of Oklahoma, aims to revoke your license and may require you to install an Ignition Interlock Device (IID) in your vehicle. The IID will be part of the Impaired Driver Accountability Program (IDAP), which you must complete to have your driving privileges reinstated.
You have the right to challenge this action by appealing the revocation of your license. However, starting in November 2022, a new law went into effect, changing how the state handles these driver’s license revocation appeals. It’s important to understand these changes as they could significantly impact your situation. Understanding the 2022 Law and Its Impact
With the new law that went into effect in 2022, if your license is revoked, you are automatically required to enroll in the IDAP and install an IID in your car for the entire revocation period. The only other option is to contest the revocation, which we highly recommend.
The IID works by preventing your car from starting if it detects alcohol on your breath. Attempts to bypass the device, such as having someone else blow into it, will be caught by video surveillance and violate the terms of your program. Violations will lengthen both your license revocation period and the amount of time you’re required to keep the IID in your car.
Costs for the IID vary, including installation and monthly rental fees. Additionally, the IDAP program costs $150, with reinstatement fees due upon completion. Successfully completing the program, covering all fees, and keeping the IID in your car for the required time are necessary steps to regain your license.
What the New 2024 Law Means for You
A new driver’s license revocation law, effective November 1, 2024, brings changes to the six-month revocation period. Under this law, you can apply for the IDAP and prevent the revocation from appearing on your driving record. However, you’ll need to make this decision within 30 days of your DUI arrest or APC arrest, without knowing for sure whether Service Oklahoma will revoke your license!

The IDAP Program: What You Should Expect
The IDAP program requires the installation of a breath test device in your vehicle, and the duration can range from 6 months to 2 years, depending on your prior DUI history and driver’s license history.
- Second Offense DUI: If you’ve had a prior revocation in the last 10 years, you’ll lose your driving privileges for one year.
- Third and Fourth DUI: If you’ve had two or more prior DUI charges within the past 10 years, you’ll lose your driving privilege for two years.
