In this video John explains the use and origin of the UCMJ, Uniform Code of Military Justice. What is the UCMJ? The UCMJ or Uniform Code of Military Justice is ...the 101 of criminal procedure in the military, from investigation, charging phase, preliminary hearing or Article 32 hearing, the Court-Martial and everything in between. Whether Summary Court Martial, Special Court Martial, or General Court Martial.

The UCMJ covers all aspects of military justice criminal procedure. The UCMJ has the A to Z of facing criminal justice in our military or steps to representing a service member in a military criminal justice action. As trial counsel or a prosecutor, it gives prosecutors the process to ensure the rights of victims and defendants are protected in military justice.

The UCMJ has the Military Rules of Evidence, MRE, similar to the Federal Rules of Evidence that ensures only the appropriate evidence is admissible, in Article 32 procedures, Motions to Dismiss, Motions in Limine, and similar proceedings that mirror state and federal criminal motions.

The UCMJ includes the criminal code as well or the criminal laws of the military, which is similar to Title 21 under Oklahoma law that covers Oklahoma criminal offenses. Everything in civilian criminal practice, such as Robbery, Murder, Larceny, and other state offenses are included in the UCMJ. However, the UCMJ also contains military specific offenses that relate to actions against Good Order and Discipline, against command directives, or other actions against military rules of professional conduct. These military specific offenses allow commanders to maintain control of service members.

Additionally, the UCMJ includes a guide and script for judges to follow the appropriate process for military justice actions. Arrested on a Military Instillation in Oklahoma? Here's What to do First!

In this video John discusses what you should do when you or a loved one are arrested on a military instillation. John discusses the three things to keep in mind ...when dealing with arrest or prosecution on a military base. The majority of these events arise from bringing a firearm onto base or illegal drugs.

Our firm has substantial experience in dealing with these matters and representing civilian contractors and military members that find themselves arrested for an offense on a military instillation in Oklahoma.

These events are handled or prosecuted in federal court as the state of Oklahoma lacks jurisdiction over these events. The cases are prosecuted by a Special US Attorney that typically works on the base on which you allegedly committed the offense. On some instillations this will be a Judge Advocate that is assigned this task; however, on some bases it will be a federal civilian attorney that has been appointed to serve as the Special US Attorney.

These cases are prosecuted in federal court, typically under a federal magistrate judge in the federal district when the offense took place and instillation is located.

We will do everything in our power to use our relationships, our experience, and the law to help you obtain a favorable outcome in federal court. Military instillations are federal territory, once you cross the threshold into a military instillation these events must be handled by the federal system.

1. First tip, you need to establish liability. Oklahoma is an At-Fault state for car accidents. So, the insurance company will want to know who caused the accident. And you want to get that taken care of as soon as possible: gather your evidence, take photographs at the scene, speak to witnesses, and get the car accident report.

2. Second, do not give statements to any insurance companies, including your own. Your insurance company and the insurance company for the driver that hit you will be calling you and requesting a statement. You should hold off on giving any statements of not only your accident, how it happened, but also your injuries.

3. The third tip, get diagnosed for any injuries you may suffer. Don’t assume the insurance companies will believe your claims of being hurt based on your statements. You need to have a professional doctor diagnose your injuries. Make an appointment with your primary care doctor or directly contact an expert, if possible, i.e. an orthopedist or chiropractor. If you've already been to the hospital you will have referrals to specialists that you need to follow up with and get scheduled.

4. The fourth tip, follow your doctor's orders for your treatment. This seems very simply; however, people often fail to follow through with treatment. It is very very important that you follow up with all of your doctor's orders. You do the treatment that they've recommended.

5. The fifth piece of advice, gather all your bills and medical records. Having a personal injury attorney can assist you in completing this step; however, you can obtain these records without an attorney. You should store your bills and medical records in an electronic folder and a paper folder that you can find. Get full bills and records from every provider for your car accident injuries.

6. Sixth, hire an expert to assist you in supporting your fault claim against the other driver. An expert, such as an accident reconstructionist can help with any deficiencies and outstanding issues in your case. If there's a problem with liability you may need to get someone to review your police reports, go to the scene, do an accident reconstruction. Alternatively, if the insurance company is claiming you have a pre-existing injury, you may need an expert or second medical opinion to support your claim.

7. Seventh tip, once you have built your case, you need to present a Demand Letter or Demand Package to the insurance companies. You will need to request policy limits or an inflated amount you believe covers all your medical records, economic impact, property damage, pain and suffering and a future costs that you have not suffered yet. It's sometimes easier to just ask for the full policy limits.

8. Eight tip, you may need to follow your demand letter with a threat of a personal injury lawsuit. Understand insurance companies often assume you will accept their denial of your insurance claim, if you are representing yourself. So, you may have to threaten or prepare to file a lawsuit, if your claims are denied.

9. Ninth tip, to potentially doubling your car accident claim, work on your liens and your policy information with the insurance companies. There may be multiple policies, insurance policies that you can pursue. Additionally, you need to consider the liens from your healthcare providers. An experienced personal injury attorney can assist you in identifying every policy available for you to pursue as well as UIM: uninsured motorist insurance or underinsured motorist insurance. Because those can add up and you can save up a lot of money to get reductions in your bills from the liens.

10. Tenth and final tip, consult with a personal injury attorney, Fierce Advocate, regarding building your case, timelines for filing your lawsuit, and supporting your injury claim. The statute of limitations in Oklahoma is two years from the date of your accident.
