Larceny is the taking of personal property accomplished by fraud or stealth, and with intent to deprive another thereof. Larceny can also occur when a person, who finds lost property, and knows the identity of the true owner, does not make a good faith effort to return to the property. Grand Larceny is a more severe larceny that happens in two cases: When the property taken has a value over $1,000, or when the property is taken from the person of another regardless of value. Oklahoma Statutes
The statute for Grand Larceny is OKLA. STAT. tit. 21 § 1704, which states that “grand larceny is larceny committed in either of the following cases: When the property taken is of value exceeding One Thousand Dollars ($1,000.00); or when such property, although not of value exceeding One Thousand Dollars ($1,000.00), is taken from the person of another. Larceny in other cases is petit larceny.”
Elements of the Crime
In order to be convicted of Grand Larceny in Oklahoma, the prosecution must prove each of the following elements beyond a reasonable doubt.
