Driving While Intoxicated (DWI) in Oklahoma
A DWI is less severe than a DUI but still carries serious consequences.
- Definition: BAC between 0.06% and 0.08%
- Penalties for a DWI:
- Fine: $100 – $500
Jail: Up to 6 months - License Suspension: 30 days (1st offense), 6 months (2nd), 1 year (3rd)
- Fine: $100 – $500
Important: DWI convictions are not predicate offenses—meaning they don’t enhance future DUI charges. However, they still remain on your record and can impact your driving and employment.
First-Time DUI
A standard DUI in Oklahoma means you had a BAC of 0.08% or higher or refused a breath or blood test.
- Penalties for A DUI:
- Fine: Up to $1,000
- Jail: Up to 1 year
- License Suspension: 6 months

Aggravated DUI
An aggravated DUI means your BAC was 0.15% or higher. Under Oklahoma’s Senate Bill 54 (2025), aggravated DUI may also include:

Penalties for an Aggravated DUI:
- Same as standard DUI (up to $1,000 fine, up to 1 year jail, 6-month suspension)
- Additional Requirements: Mandatory drug and alcohol assessment, possible inpatient treatment, and installation of an ignition interlock device (IID) on your vehicle.
DUI-Drugs (DUI-D)
You can be charged with DUI even if you weren’t drinking. DUI-Drugs (DUI-D) applies if you operate a vehicle with any intoxicating substance in your system, including:
- Illegal drugs: heroin, fentanyl, cocaine, ecstasy
- Prescription medications: Xanax, Valium, Ambien, Tylenol with codeine
- Medical marijuana
Penalties for a DUI-D are the same as standard DUI—up to $1,000 fine, up to 1 year jail, 6-month license suspension.
Actual Physical Control (APC)
Even if you’re not driving, you can be charged with Actual Physical Control (APC) if:
- You are intoxicated,
- You are inside your car,
- You have the ability to operate it (for example, keys in your pocket).
Penalties for an APC are tame as a DUI—fine up to $1,000, up to 1 year jail, 6-month license suspension.
WARNING: APC is considered a predicate offense and counts against you for future DUI charges.
Repeat DUI Offenses in Oklahoma
Oklahoma treats repeat DUI offenders harshly.
- Second DUI (within 10 years):
- Fine: Up to $2,500
- Jail: Up to 5 years
- License Suspension: 1 year
- Charge elevated to a felony
- Third DUI:
- Fine: Up to $5,000
- Jail: Up to 10 years
- License Suspension: 2 years
