Drug Trafficking in Moore, OK

Drug trafficking by definition is the distribution of a controlled substance for the purpose of being sold. The law in Oklahoma sets out a list of illegal drugs that are defined as controlled substances under The Oklahoma Trafficking and Illegal Drugs Act. This Act criminalizes drug trafficking and sets out the penalties for a drug trafficking conviction.

As per the Act, if you are found with a large quantity of illegal drugs in your possession, if you knowingly distribute, manufacture, or bring into this state a controlled substance, you can be charged with drug trafficking within the state of Oklahoma. You can also be charged with this drug crime if you possess a controlled substance with the intent of manufacturing another controlled substance.

Drug trafficking is distinct from the crime of distribution, or intent to distribute, in that it usually involves serious criminal activities or a large volume of a controlled substance.

Federal Drug Trafficking Charges

Drug trafficking in Oklahoma can be charged as a federal or state crime. Generally, the more serious the drug crime you committed, the more likely it is to be charged as a federal crime. In relation to a drug trafficking charge, if you are caught trafficking a controlled substance across state lines, your drug charges will be federal.

However, it is not required that drug trafficking be a serious crime in order to be charged at a federal level. Federal law (21 U.S. Code § 841) defines trafficking as:

“1. knowingly or intentionally– (1) to manufacture, distribute, or dispense, or possess with intent to manufacture, distribute, or dispense, a controlled substance; or

2. to create, distribute, or dispense, or possess with intent to distribute or dispense, a counterfeit substance.”

The federal government of the United States takes a very serious approach to drug-related crimes, in particular drug trafficking.
